France challenges arbitration award, Tapie investigated

PARIS (Reuters) - A tycoon with ties to ex-president Nicolas Sarkozy was put under formal investigation on suspicion of fraud on Friday in connection with a 403 million-euro ($524 million) arbitration award he received in 2008 to settle a legal dispute.

The case against Bernard Tapie could damage Sarkozy's ability to mount a comeback for the 2017 election. Investigators are trying to determine whether close ties between members of Sarkozy's inner circle and Tapie influenced a 2007 government decision to turn to a private arbitration tribunal to settle a dispute with now-defunct bank Credit Lyonnais.

Tapie, 70, a colorful member of France's business and sporting elite, was placed under investigation on suspicion of organized fraud after being questioned by police over four days.

Earlier, the state-controlled body charged with settling the debts of Credit Lyonnais, the Consortium de Realisation (CDR), petitioned the Paris appeals court to throw out the settlement Tapie received, the agency's lawyer, Pierre-Olivier Sur, told Reuters.

Tapie, a supporter of Sarkozy in the past two presidential elections, has denied any wrongdoing in the long-running case which has embroiled members of Sarkozy's former cabinet including International Monetary Fund head Christine Lagarde, his former finance minister.

"I stress there is nothing in the case file to show the arbitration was the result of fraud," Tapie's lawyer, Herve Temime, told reporters after announcing the move to place his client under formal investigation.

Under French law, such a step means there is "serious or consistent evidence" pointing to likely implication of a suspect in a crime. It often, but not always, leads to a trial.

CONSERVATIVE HEADACHES

Socialist President Francois Hollande, who came to power last year vowing to do away with what he said were unfair advantages accorded the rich and well-connected, had signaled that his government planned to challenge the arbitration.

In order to nullify the settlement, judges would have to find evidence of fraud.

Tapie claimed that Credit Lyonnais defrauded him by buying his stake in sports company Adidas in 1993 for 315.5 million euros only to sell it a year later for 701 million euros.

The arbitration went in Tapie's favor with the 285-million-euro award which, with interest, amounted to 403 million euros.

Also under formal investigation is a former aide to Lagarde, Stephane Richard, now the chief executive of France Telecom, who plans to appeal the decision.

Investigating magistrates have made Lagarde a "supervised witness" in the case, a less serious step than a formal investigation that means she will answer questions as a witness in the presence of her lawyer in any future hearings.

The fraud-related investigation of Tapie and Richard increases the likelihood of a trial that could further tarnish the image of the conservative party, which lost power last year with Sarkozy's defeat to Hollande.

Boston Marathon bombings suspect Dzhokhar Tsarnaev allegedly left a written confession in a boat where he was captured by law enforcement officials in April, writing, ?I don?t like killing innocent people,? but suggesting it was ?allowed? because of U.S. actions abroad.

?The U.S. Government is killing our innocent civilians. I can?t stand to see such evil go unpunished. We Muslims are one body, you hurt one, you hurt us all,? Tsarnaev allegedly wrote. ?Stop killing our innocent people, we will stop.?

The details were revealed in a 30-count indictment by a federal grand jury Thursday that charges Tsarnaev, 19, with using weapons of mass destruction in the April 15 bombings and killing four people.

Authorities say Tsnarnaev and his older brother, Tamerlan, planted two pressure-cooker bombs near the marathon?s finish line. The bombs, which were detonated within seconds of each other, killed three people and injured more then 260. The indictment says the bombs were constructed in a manner "designed to shred flesh, shatter bone and cause extreme pain and suffering, as well as death."

Tsarnaev was also indicted in the April 18 death of MIT police officer Sean Collier, who was shot while Tsarnaev and his brother were on the run from police. According to the indictment, the brothers were heavily armed while attempting to escape, having in their possession five IEDs, a handgun, ammunition, a machete and a hunting knife.

Tamerlan Tsarnaev was killed following a shootout with police on April 19 in Watertown, Mass., outside of Boston. The indictment offered new details on his death, saying it came after the brothers were trying to "shoot, bomb, kill or disable" police officers trying to apprehend them. Tamerlan Tsarnaev was tackled by three police officers when his younger brother ran back to a Mercedes they had stolen earlier and "drove it directly at the three officers." One of the officers tried to "drag" the older brother out of the way, but the Dzhokhar Tsarnaev ran over him "seriously injuring him and contributing to his death."

Tsarnaev was captured later that day, hiding in a boat parked in a nearby backyard. He's currently being held in a federal prison outside Boston.

According to the indictment, Tsarnaev downloaded several pieces of extremist Islamic propaganda from the Internet prior to the bombings, including a book that warned Muslims not to give allegiance to governments who invade foreign lands. The book featured a forward from Anwar Al-Awalaki, an American-born Muslim cleric who became a senior operative in al-Qaida and was killed in a 2011 U.S. drone strike in Yemen.

According to the U.S. Attorney's office in Boston, 17 of the charges against Tsarnaev could bring the death penalty or life in prison. He's scheduled to be arraigned on July 10 at the U.S. District Court in Boston.

Cold spring 'blasted' winged insects

Winged insects including bees, moths and butterflies are suffering this year following the UK's late, cold spring, a National Trust report has revealed.

The charity warns the drop in numbers of winged insects could lead to food shortages for birds and bats.

The six-month review assessed the state of plants and animals in England, Wales and Northern Ireland and came up with a "winners and losers" list.

Snowdrops, bluebells and daffodils are all on the winners list

Among the "losers", butterflies have been "very scarce" this year, due to a combination of an unsettled spring and the last year's extremely wet summer.

Likewise, moth numbers have been driven down by cool, wet or windy nights over the past few months.

Mason bees and mining bees also struggled to survive in poor weather in May, which may have a knock-on effect for plant pollination.

"Insect populations have been really very low. Then when they have got going they've been hit by a spell of cool, windy weather... so our environment is just not bouncing with butterflies or anything else," said Mathew Oates, a naturalist at the National Trust, who worked on the report.

He acknowledged insects follow a "boom and bust pattern", but explained: "The concern is when you have a sequence of poor summers, then a lot of small [insect] populations are lost... and they [effectively] retreat back to the nature reserves."

Birds on the "losers" list include martins, swifts, swallows and warblers, all of which rely on airborne insects to feed and may struggle to survive in the coming months.

Some seabird populations have been hard hit too. In March windy weather along the coast of Scotland and northern England led to the apparent starvation of thousands of puffins along with guillemots, razorbills, kittiwakes and shags.

However, a number of animals and plants have enjoyed a more fruitful year, earning a place on the list of "winners" of the first half of 2013.

Snowdrops and daffodils had "amazingly long flowering seasons", according to the charity, with daffodils flowering well into May and snowdrops appearing from January through to mid-April.

And the weather hasn't been problematic for all birds: Rooks are less sensitive to poor conditions than other birds and 2013 has so far been a "superb" year for the animals, following reports of a very successful breeding season.

Mr Oates said: "This year winter was loathe to let go. All of this has meant that spring got seriously behind and was the latest since 1966."

The delayed spring, beginning with the coldest March in 50 years, meant frogs and toads struggled to breed in water that was still frozen and many flowering plants in gardens and in the wild such as dogwood, elder and lilacs, bloomed weeks later than normal.

Mr Oates said that people and wildlife alike in Britain are now "crying out for a long hot summer."

"Summer is now running two to three weeks late but may come good yet."

Speculating ahead to the second part of 2013, the National Trust predicts a good year for cabbage white butterflies which appear in July and August. Late-flowering apple varieties are also expected to be abundant following some good weather for pollination in early June.

Snowden's limbo in purported airport hideout

MOSCOW (AP) ? Russian President Vladimir Putin says that fugitive National Security Agency leaker Edward Snowden has been in the transit zone of Moscow's Sheremetyevo airport since flying in from Hong Kong ? meaning that he has not officially entered the country. If true, it's effectively a life of airport limbo for Snowden, whose American passport has been revoked by U.S. authorities.

Here's a look at the place and how it operates.

WHAT IT'S LIKE

The area where Snowden is purportedly staying serves both connecting passengers traveling via Moscow to onward destinations and passengers departing from Moscow who have passed border and security checks. An Associated Press reporter entered the area Wednesday by flying from Kiev, Ukraine.

The huge area unites three terminals: the modern, recently built D and E, and the older, less comfortable F, which dates to the Soviet era. The transit and departure zone is essentially a long corridor, with boarding gates on one side and gleaming duty free shops, luxury clothing boutiques and souvenir stores selling Russian Matryoshka dolls on the other. About a dozen restaurants owned by local and foreign chains serve various tastes.

Hundreds of Russian and foreign tourists await flights here, some stretched out on rows of gray chairs, others sipping hot drinks at coffee shops or looking out through giant windows as silver-blue Aeroflot planes land and take off.

Business ran as usual at the terminals on Wednesday morning. An Asian girl, about 10 years old, slept peacefully on her father's lap. A middle-aged mother and her teenage daughter tried out perfume samples at a duty free store, while nearby a woman in a green dress picked out a pair of designer sunglasses. A pilot was buying lunch at Burger King.

NO TRACE OF SNOWDEN

Putin insisted Tuesday that Snowden has stayed in the transit zone without passing Russian immigration and is free to travel wherever he likes. Snowden, who arrived Sunday on a flight from Hong Kong, registered for a Havana-bound flight Monday en route to Venezuela, but didn't board the plane. His ultimate destination was believed to be asylum in Ecuador. Dozens of Russian and foreign journalists boarded the Havana flight only to photograph Snowden's empty seat 17A during the 12-hour journey.

The U.S. move to annul Snowden's passport might have further complicated his travel plans.

Hordes of journalists armed with laptops and photo and video cameras have camped in and around the airport, looking for Snowden or anyone who may have seen or talked to him. But after talking to passengers, airport personnel, waiters and shop clerks, the press corps has discovered no trace of the elusive leaker.

Russian news agencies, citing unidentified sources, reported that Snowden was staying at a hotel in the transit terminal, but he was nowhere to be seen at the zone's only hotel, called "Air Express." It offers several dozen capsule-style spaces that passengers can rent for a few hours to catch some sleep. Hotel staff refused to say whether Snowden was or has in the past stayed there.

"We only saw lots of journalists, that's for sure," said Maxim, a waiter at the Shokoladnitsa diner not far from Air Express. He declined to give his last name because he wasn't allowed to talk to reporters.

PLACES TO HIDE

The departure and transit area is huge and has dozens of small rooms, some labeled "authorized personnel only," where one could potentially seek refuge with support from airport staff or security personnel. And security forces or police patrolling the area can easily whisk a person out of this area though back doors or corridors.

There are also a few VIP lounge areas, accessible to business-class passengers or people willing to pay some $20 per hour. Snowden was not seen in those areas.

Exiting the area would either require boarding a plane or passing through border control. Both require a valid passport or other identification.

Sheremetyevo's press service declined to comment on Snowden's whereabouts. A policeman at the airport laughed off a question from an AP reporter about Snowden's whereabouts. "Journalists have searched this place for three days and have found nothing. Was he ever here in the first place?" the policeman asked. He spoke to the Associated Press on condition of anonymity, because he was not authorized to talk to the media.

Texas woman set to be 500th execution in state

HUNTSVILLE, Texas (AP) ? Texas, the nation's busiest death penalty state, is set to mark a solemn moment in criminal justice Wednesday with the execution of convicted killer Kimberly McCarthy.

If McCarthy is put to death in Huntsville as planned, she would become the 500th person executed in Texas since the state resumed carrying out the death penalty in 1982. The 52-year-old also would be the first woman executed in the U.S. since 2010.

McCarthy's attorney, Maurie Levin, said she has exhausted all efforts to block the execution, after denials by the Texas Court of Criminal Appeals.

"If there was something to appeal, I would," said Levin.

Texas has carried out nearly 40 percent of the more than 1,300 executions in the U.S. since the Supreme Court allowed capital punishment to resume in 1976. The state's standing stems from its size as the nation's second most populous state as well as its tradition of tough justice for killers.

With increased debate in recent years over wrongful convictions, some states have halted the practice entirely. However, 32 states have the death penalty on the books. Still, it's clear the debate over capital punishment has touched Texas, with lawmakers providing more sentencing options for juries and courts narrowing the cases for which death can be sought.

McCarthy faces execution for the 1997 robbery, beating and fatal stabbing of retired college psychology professor Dorothy Booth. Booth had agreed to give McCarthy a cup of sugar before she was attacked with a butcher knife at her home in Lancaster, about 15 miles south of Dallas. Authorities say McCarthy cut off Booth's finger to remove her wedding ring.

Police also had linked two other slayings to McCarthy, a former nursing home therapist who became addicted to crack cocaine.

In her appeals, McCarthy contended prosecutors improperly excluded black jurors and that her lawyers failed to challenge the moves at trial or in early appeals. McCarthy is black, and Booth was white. All but one of the 12 jurors at McCarthy's trial were white.

In January, McCarthy had been moved to a small holding cell a few steps from the Texas death chamber when a Dallas judge moved her execution to April. That timing then was reset for June when Dallas County District Attorney Craig Watkins said he wanted to await the outcome of capital punishment-related bills before lawmakers in Austin.

On Tuesday, the Texas Court of Criminal Appeals declined to reconsider its denial a day earlier of McCarthy's appeal, saying her claims should have been raised previously.

Levin, a University of Texas law professor, said because the court's ruling focused on a procedural and not a substantive issue, the case cannot be appealed to the U.S. Supreme Court.

"The shameful errors that plague Ms. McCarthy's case ? race bias, ineffective counsel and courts unwilling to exercise meaningful oversight of the system ? reflect problems that are central to the administration of the death penalty as a whole. For this to be the emblem of Texas' 500th execution is something all Texans should be ashamed of," Levin said.

McCarthy declined to speak with reporters as her execution date neared.

Anti-death penalty groups planned to protest outside the Walls Unit in Huntsville, where McCarthy is set to receive a lethal injection Wednesday evening.

"The whole world is looking at Texas," said Gloria Rubac, with the Texas Death Penalty Abolition Movement in Houston.

McCarthy would be the 13th woman nationwide and the fourth in Texas put to death since 1976. In the same period, more than 1,300 men have been executed nationwide, 496 of them in Texas. Virginia is a distant second, nearly 400 executions behind.

Federal statistics show that over the past three decades women account for about 10 percent of convicted murderers. According to the NAACP Legal Defense Fund, there were 63 women on death row in the U.S. as of Jan. 1, representing 2 percent of the nation's 3,125 condemned prisoners.

Prosecutors showed that McCarthy stole Booth's Mercedes and drove to Dallas, pawned the wedding ring she had removed from the woman's severed finger for $200 and then went to a crack house to buy cocaine. Evidence also showed she used Booth's credit cards at a liquor store.

Booth's DNA was found on a 10-inch butcher knife recovered from McCarthy's home.

McCarthy blamed the crime on two drug dealers, but there was no evidence either existed.

Blood DNA evidence also tied McCarthy to the December 1988 slayings of 81-year-old Maggie Harding and 85-year-old Jettie Lucas. Harding was stabbed and beaten with a meat tenderizer, while Lucas was beaten with both sides of a claw hammer and stabbed.

McCarthy, who denied any involvement in the attacks, was indicted but not tried for those slayings.

McCarthy is a former wife of Aaron Michaels, founder of the New Black Panther Party, and he testified on her behalf. They had separated before Booth's slaying.

Friend: James Gandolfini died of heart attack

ROME (AP) ? An autopsy on James Gandolfini has found that the "Sopranos" star died of a heart attack, with no evidence of substance abuse or foul play, a family spokesman said Friday.

Michael Kobold told reporters that Gandolfini's body has been released to a funeral director and that the family was working with the Italian government to speed up the bureaucratic red tape to get the body back to the United States soon.

While the process can take up to 10 days, Kobold said the family was hoping to have the body repatriated by mid-week with a funeral planned in New York by June 29 at the latest.

Gandolfini, 51, died Wednesday night. His body was discovered in a Rome hotel room by a family member.

He had arrived in Rome on Tuesday and spent his first full day in the Eternal City with his teen-age son, visiting the Vatican and staying at the luxury Boscolo Exedra hotel. They dined together in the hotel on Wednesday night, awaiting the arrival in Rome of Gandolfini's sister, Leta.

"He had a wonderful day," Kobold said of the father-son vacation.

Asked if Gandolfini had a history of heart problems, Kobold said he was healthy.

"There's nothing out of the ordinary. It was a heart attack. It was a natural cause," he said in response to questions about the autopsy. "There was no foul play, no substance abuse. None of that."

The Associated Press couldn't independently confirm the results of the autopsy, and it wasn't clear if Italian officials would independently release them.

In 2002, allegations of drug use by Gandolfini spilled into tabloid reports during his divorce case with his first wife, Marcy Wudarski. Gandolfini's then publicist Dan Klores was quoted as acknowledging the actor's prior drug and alcohol abuse, but claimed it was "a problem that existed in the past."

Morgue officials at Rome's Policlinico Umberto I hospital said the U.S. Embassy had told them not to speak to the media, and that a family representative would provide information about the autopsy. Kobold, a longtime family friend, said he had been asked by the family to act as its spokesman.

Kobold provided no written evidence of the autopsy results. The director of the emergency room at the hospital, Dr. Claudio Modini, said on Thursday prior to the autopsy that Gandolfini had suffered a cardiac arrest. Sudden cardiac arrest can be due to a heart attack, a heart rhythm problem, or as a result of trauma.

Leta went to the morgue on Friday to formally identify the body.

Gandolfini was to have helped preside over the closing ceremony on Saturday of the Taormina Film Festival in Sicily. The festival instead is organizing a tribute to him.

His portrayal of criminal Tony Soprano in HBO's landmark drama series "The Sopranos" was just one facet of his rich legacy as an actor in movies and plays.

LG's Optimus G followup to feature a Snapdragon 800 CPU

LG and Qualcomm have enjoyed a close relationship for mobile phone chips, and it appears that will continue with the next Optimus G device, which is due in Q3. A press release tonight promises it will feature a Snapdragon 800 CPU for "the ultimate mobile experience" -- a claim benchmarks seem to back up. Qualcomm says the new 800 chip can best the original Optimus G's S4 Pro by "up to 75 percent" in performance, although what may be more interesting is how this aligns with a LS980 handset that recently leaked on Sprint's website. The release also highlights the new chip's ability to use LTE Advanced carrier aggregation for even faster bandwidth speeds, so while a Galaxy S 4 variant may deliver the feature first, it probably won't be alone for long.

James, Heat beats Spurs 103-100 in OT; Game 7 next

(AP) ? LeBron James led a title-saving charge, and now his crown will be on the line one more time in Game 7.

James powered Miami to a frantic fourth-quarter rally and overtime escape as the Heat beat the San Antonio Spurs 103-100 on Tuesday night to extend the NBA Finals as far as they can go and keep Miami's repeat chances alive.

Losing his headband but keeping his cool while playing the entire second half and overtime, James finished with 32 points, 10 rebounds and 11 assists, making the go-ahead basket with 1:43 remaining in the extra period.

"If we were going to go down tonight, we're going to go down with me leaving every little bit of energy that I had on the floor," James said.

Tim Duncan scored 30 points for the Spurs, his most in an NBA Finals game since Game 1 in 2003, but was shut out after the third quarter. He added 17 rebounds.

Game 7 will be here Thursday, the NBA's first do-or-die game to determine its champion since the Lakers beat the Celtics in 2010.

"They're the best two words in sports: Game 7," Heat coach Erik Spoelstra said.

And two the Spurs were oh so close to avoiding.

They looked headed to a fifth title in five chances when they built a 13-point lead with under 4 minutes left in the third quarter, then grabbed a five-point edge late in regulation after blowing the lead.

But James hit a 3-pointer and Ray Allen tied it with another. Just 5.2 seconds remained in regulation. The Heat were that close to the edge.

"It's a tough moment. We were a few seconds away from winning the championship and we let it go," Spurs veteran Manu Ginobili said. "A couple rebounds we didn't catch, a tough 3 by Ray and a couple missed free throws. It's a very tough moment."

James was just 3 of 12 after three quarters, the Heat trailing by 10 and frustration apparent among the players and panic setting in among the fans.

Nothing to worry. Not with James playing like this.

He finished 11 of 26, even making a steal after his basket had given Miami a 101-100 edge in the OT.

Before that, he was 12 minutes from hearing the familiar criticisms about not being able to get it done, from having to watch a team celebrate on his home floor again.

Then he changed the game and erased that story.

The Heat, who haven't lost consecutive games since Jan. 8 and 10, had too much defense and way too much James for the Spurs in the final 17 minutes. They are trying to become fourth team to win the final two games at home since the NBA went to the 2-3-2 format for the finals in 1985.

James came in averaging 31.5 points in elimination games, highest in NBA history, according to a stat provided through the NBA by the Elias Sports Bureau.

This wasn't quite the 45-point performance in Game 6 of last year's Eastern Conference finals in Boston, but given the higher stakes may go down as more important ? if the Heat follow it with another victory Thursday.

The Heat were in the same place as they were in 2011 at the end of their Big Three's first season together, coming home from Texas facing a 3-2 deficit in the finals.

This is a different team. And oh, what a different James.

They said they welcomed this challenge, a chance to show they how much mentally tougher they were than the team the Dallas Mavericks easily handled in Game 6 that night.

James made sure they did, looking nothing like the player who was so bad in the fourth quarters during that series.

He was simply unstoppable down the stretch of this one.

"He just made plays. I don't think there's any two ways to put it," Duncan said. "We were in the right position to close it out and he found a way to put his team over the top and we just didn't make enough plays to do that."

Kawhi Leonard had 22 points and 11 rebounds for the Spurs. Tony Parker had 19 points and eight assists, but shot just 6 of 23 from the field.

The Spurs had one final chance down 103-100, but Chris Bosh blocked Danny Green's 3-pointer from the corner as time expired.

Bosh had said Green wouldn't get open the way he has all series ? and he didn't.

Green finished 1 of 5 from behind the arc after going 25 of 38 on 3-pointers (65.8 percent) in the first five games.

The Heat, the NBA's 66-win powerhouse during the regular season, will be playing a seventh game for the second straight round, having needed to go the distance to beat the Indiana Pacers in the East finals.

"See you in Game 7!" the public address announcer hollered as some Heat fans tossed their white T-shirts ? the ones that hang on chairs in the arena. These read "First to 16 Wins," meaning the number of victories it takes to win the championship.

The race will go down to a final day.

The Heat are 13-0 after losses over the last five months, though this was nothing like the previous 12 that had come by an average of nearly 20 points. Nor was it like the previous four games of this series, which had all been blowouts after the Spurs pulled out a four-point victory in Game 1.

San Antonio had an 11-0 run in the first half, then a 13-3 burst in the third quarter for a 71-58 lead, and a final flurry late in regulation that seemed to have them ready to walk off with another title.

Parker's 3-pointer over James tied it at 89 with 1:27 left. He then came up with a steal, spinning into the lane for a 91-89 lead with 58 seconds to go. Miami coughed it up again and Ginobili made two free throws, and he made another after a third straight Miami turnover to put the Spurs ahead 94-89.

But James nailed a 3-pointer with 20 seconds left, and the Heat had one more chance after Leonard made just one foul shot to give the Spurs a 95-92 edge. James missed but Bosh got the rebound out to Allen, the league's career leader in 3-pointers, who made another one from the corner to even it up.

The Spurs went ahead by three again in overtime, but James found a cutting Allen for a basket, then scored himself to put the Heat on top. They clinched it when Bosh blocked San Antonio's final two shot attempts.

Bosh finished with 10 points and 11 rebounds. Mario Chalmers scored 20 points and Dwyane Wade had 14.

After shooting 60 percent in Game 5, the Spurs hadn't cooled off when they traded Texas heat for the South Florida sun, making nine of their first 12 shots to open a 20-16 lead. Duncan made all six shots in the first quarter, but consecutive 3-pointers by Shane Battier and Chalmers late in the period rallied Miami to a 27-25 advantage.

Duncan made his first eight shots, scoring 13 straight San Antonio points over nearly 8 minutes in the second quarter. Boris Diaw finally stopped that stretch with a little scoop shot in the lane and Leonard tipped in a miss with 1.3 seconds left, capping the Spurs' 11-0 run to end the second quarter. It was 50-44 at the break.

With Duncan 37 and Ginobili nearly 36, the Spurs know they may never get another shot like this one.

Duncan knew how tough it would be to get back to the top six years ago, when the Spurs swept James' Cleveland Cavaliers for their most recent title.

San Antonio's leader told James afterward that the league would someday belong to him.

And on Tuesday, James refused to let it go.

Notes: Allen moved two behind Kobe Bryant and Derek Fisher (48) for second place in finals 3-pointers. Robert Horry, a former champion with the Spurs, made 56 3-pointers in the finals. Horry held the Spurs' record for 3s in a finals with 15 in 2005 that Green has broken with his finals-record 26. ... Duncan and Spurs coach Gregg Popovich appeared in their 210th playoff game together, moving 30 ahead of Phil Jackson and Bryant for most all-time.

Credit-Management Tips for Recent College Graduates

The summer after graduation is a crucial time for college graduates to adjust their budgets and make some important financial decisions. Transitioning into the work world, earning a steady paycheck and changing your lifestyle as a young adult can have an impact on your financial future. Creating a plan to pay off credit card debt, as well as minimize credit card use, can position you for financial success.

Here are five credit-management tips to get you started:

1. Check your credit report. You're entitled to one free credit report every 12 months at www.annualcreditreport.com. Take the time to check the report for errors, and contact the appropriate parties to make corrections if needed. Keep in mind your credit history is not only used by mortgage lenders and credit card issuers but also used by a number of employers when screening job applicants.

2. Use credit cards minimally. Even if you relied on credit cards during college to pay for tuition, books or everyday expenses, now is the time to break the habit. As you start your new career and are busy taking care of other responsibilities, tacking on more credit card debt can make your early 20s that much more stressful. As such, create a realistic spending plan that involves paying for most items with cash. Don't turn to credit cards to pay for luxury expenses such as vacations, a new computer or other big-ticket items. However, keep one credit card in your wallet for emergencies, and charge a small purchase to the card every four or five months, as some creditors close accounts if a customer's card is inactive for a long period of time.

3. Create a debt payoff plan. If you're like many college graduates, you're juggling credit card debt and student loan debt. If student loan payments have you overwhelmed, consider loan consolidation options, by which you create a payoff plan based on your current income and can start whittling down your student loan debt as soon as possible. Neglecting to budget for these payments will set you back financially in the long term, and could leave you stuck in debt for several years.

4. Recognize credit traps that are in disguise. "Would you like to open a credit card with us today? You'll save 15 percent on your purchase." You may hear such an offer when checking out at your favorite electronics store. These may promise short-term gains but aren't typically good credit card offers. Do your homework, and read the fine print so you fully understand the terms and conditions. Consider what the rates are after the promotional period ends and if there are any extra processing or account maintenance fees involved.

5. Design a bill payment schedule. Paying your bills on time can help you maintain good credit and establish a solid credit history. Create a calendar or bill payment schedule so you don't miss a payment. Keep in mind even a single missed payment can show up on your credit report, which may lower your credit score. Stay on top of due dates for your monthly bills, and make those payments at least six to seven business days in advance to ensure the payments are processed on time.

A Georgetown public health expert and attorney examines what the FDA must do to prevail

WASHINGTON When the U.S. Food and Drug Administration (FDA) imposes new graphic warning labels for tobacco products, they can survive a First Amendment challenge if they depict health consequences and their effectiveness is supported by adequate scientific evidence, says a Georgetown University Medical Center public health expert and attorney.

Graphic tobacco warning labelswhich combine images with health warningsare a widely used tool for reducing tobacco use in other countries, but the tobacco industry argues they are unconstitutional in the United States.

In an analysis of legal and scientific issues for graphic warning labels published in the American Journal of Preventive Medicine, John Kraemer, JD, MPH, outlines how the courts will likely analyze graphic warnings and identifies what health evidence must be presented to survive a legal challenge. Kraemer is an assistant professor of health systems administration at Georgetown University School of Nursing & Health Studies and member of the O'Neill Institute for National and Global Health Law.

Despite the fact that smoking kills 443,00 Americans each year, Kraemer says, "The U.S. has some of the weakest tobacco warning labels in the world, and they haven't been updated in almost 30 years."

In 2009, Congress passed the Family Smoking Prevention and Control Act requiring graphic warning labels on tobacco products, giving the FDA authority to specify the images and text that must be included. The FDA issued nine graphic warnings in June 2011, but withdrew them after two federal appeals courts came to opposite conclusions about their constitutionality.

Though ambiguity exists over what constitutional standard would be applied in a legal challenge to the labels, Kraemer argues that it is possible for the FDA to meet the two most likely standards rational basis review and intermediate reviewwith the right scientific evidence.

Kraemer says the labels would likely be analyzed under rational basis review and almost certainly prevail "if the courts decide the warnings combat the industry's past deception." He says some courts have also applied this review to uncontroversial, factual warnings, such as information intended to help consumers make healthier decisions.

The second possibility is intermediate review, which requires a stronger governmental interest and greater certainty that warning labels would be effective.

"Under this review, the FDA could likely win, but the case will turn on how well the government can convince the courts about certain empirical evidence," Kraemer explains. "Providing clear evidence of [graphic warning labels'] impact on smoking rates themselves or for the causal mechanism [by which they reduce smoking] would meet the Court's test."

He adds that the FDA must also take care to avoid images that could be interpreted as opinions instead of facts or which do not show a negative health consequence of smoking, such as an image previously adopted by the FDA, which depicted a man with a no-smoking sign on his shirt.

Second City co-founder Bernard Sahlins dies at 90

CHICAGO (AP) ? Bernard "Bernie" Sahlins, who co-founded Chicago's Second City theater and who nurtured the early careers of many of the earliest stars of "Saturday Night Live," died Sunday. He was 90.

Andrew Alexander, one of Second City's current owners and its CEO, told The Associated Press that Sahlins died peacefully at his Chicago home with his family nearby. He is survived by his wife, Jane Nicholl Sahlins.

Sahlins and business partners Howard Alk and Paul Sills opened The Second City in December 1959, and it quickly gained national attention and helped establish Chicago as a vibrant comedy town, the Chicago Sun-Times reported (http://bit.ly/1bLDRZo ).

The Second City wasn't Sahlins' first attempt at running a theater. He was a producer-investor in a theater troupe in the early 1950s that was comprised of many fellow University of Chicago graduates, and he and several business partners produced plays at the Studebaker Theater from October 1956 until the following year, when it had to close due to a lack of funding.

In his 2002 memoir, "Days and Nights at the Second City," Sahlins wrote that he, Alk and Sills hadn't set out to build another theater.

"We had been burned enough times doing that. This was still the Beat generation, and we started out to found a coffee house where we idlers, including the actors whom we had with for years, could loll around and put the world in its proper place."

But The Second City caught on within months of opening, despite some early money problems and other issues, and it became instrumental in the growth and development of improvisational and sketch comedy.

Sahlins had an eye for talent, and he hired and nurtured the early careers of such future stars as John and Jim Belushi, Joan Rivers, Dan Aykroyd, Bill Murray, Gilda Radner and Harold Ramis, among others.

Shortly after "Saturday Night Live" began airing in the fall of 1975, Second City became a breeding ground for the show. According to Second City producer emeritus Joyce Sloane, who died in 2011, Sahlins once half-jokingly commanded her to lock "SNL" creator and producer Lorne Michaels out of the building, the Sun-Times reported.

Alexander, who along with business partner Len Stuart bought The Second City from Sahlins in 1985, according to the theater's website, told the AP that Sahlins will be remembered for always urging performers to work at the top of their intellect, and that this is still preached at the theater today.

"You think about that theater, and think of all the stars that came out of it ... from Belushi to Aykroyd to Allan Arkin. It's extraordinary, the amount of talented people that came out of it," Alexander said.
